In the instant case Mr Moore acted as instructing solicitor for the Husband. The Husband sought joinder of the Second and Third Respondents in respect of declaratory relief against them, including, that the Second and Third Respondents held real property on trust for the husband and the wife, which application was resisted by the Respondents. In the result, the Second and Third Respondents were joined notwithstanding their submission that, inter alia, joinder would, adopting the words of Her Honour the Honourable Justice Rees at paragraph 11:
“…transform the proceedings from a relatively vanilla matrimonial division of property into a large and complex dispute involving multiple parties and ownership of a highly valuable item of real property”.
